Colorado! The first to tax the sick! (Directly)
Voters in the western Colorado town of Fruita on Tuesday approved a 5 percent sales tax on medical marijuana and related paraphernalia, making it the first city in Colorado to tax pot…
…“Colorado law is clear: Medical marijuana, in most instances, should be subject to state and local sales taxes,” Suthers said. “This formal opinion should help clear up many of the uncertainties surrounding the taxation of medical marijuana.”
The first comment would be most logical after you told someone after you taxed their prescription.
“I disagree with Mr. Suthers because according to Colorado Statute any perscribed medications are exempt from taxation. Since you have to have a prescription to obtain the Medical Marijuana, it then becomes a prescription medication. To me taxing the Medical Marijuana actually violates the state tax code and that of nearly every other muncipality. If Mr. Suthers would like to remove the exemption from prescription medications and subject all prescription medications to tax, then I suppose he can with legislative approval. If you want to make it legal and put an age restriction on it, then by all means tax it like it was tobacco. Until then it is a prescription medication and should be treated as such. By the way, I have no intention of ever obtaining medical marijuana and I have never smoked or ingested the stuff. I just think our government should follow their own rules.
